Q. 당사는 부동산건설업을 영위하며 K-IFRS에 따라 회계처리하고 있습니다. 아파트 건설을 위해 2022년에 토지를 취득하고 재고자산 계정과목으로 처리했습니다. 2023년에 A업체와 설계용역계약을 체결하고 계약금 5억원을 지급하고 선급금으로 처리하였습니다. 2024년에 설계용역대금 반환소송을 위해 법무법인에 소송진행비용을 지급하고자 합니다.

이러한 경우, 소송진행비용은 지급수수료(비용)처리하면 되는지 아니면 재고자산으로 자본화해야하는지 궁금합니다.

A. 문의하신 내용은 재고자산 취득원가의 범위입니다.

재고자산의 취득원가의 목적한 자산의 형태로 제조하기 위한 원가이므로, 설계용역비가 아파트라는 자산을 위한 필수적인 지출이라면 자본화하게 됩니다. 반면, 대부분의 소송비용은 재고자산과 직접 관련된 것이 아니라 관리원가 또는 낭비된 원가로서 자본화대상에 해당하지 않습니다만, 귀사의 소송비용의 성격에 대한 판단이 필요할 것입니다.
